But inasmuch as Section 7 of Ordinance W.26 of 1889 authorizes such to be made by some officer of the Chinese Government, I had doubts as to whether I should refuse to call upon Magistrate to issue a warrant, this more so as it is no doubt desirable to assist the Chinese Government in their endeavours to arrest criminals.
I therefore legitimately consulted the Attorney General on the matter and he advised that the warrant should issue but that the prisoners, if arrested, should not be delivered up unless the different provisions of the Ordinance were duly fulfilled. I have mentioned these cases somewhat in detail so that Your Lordship may understand the circumstances under which criminals, in so far as we legitimately can.
